If you are accessing our Website from another jurisdiction, your personal information may be transferred to, stored in, and processed in the United States and other countries where we or our service providers operate. GATHERING, USE AND DISCLOSURE OF NON-PERSONALLY-IDENTIFYING INFORMATION
Users of the Website Generally.

Web Beacons.
A “Web Beacon” is an object embedded in a web page or email that can help determine whether a page or email was viewed or whether a link was used. Company may use Web Beacons on the Website and in emails to measure visits, email engagement, campaign performance, and use of co-branded services. Depending on how a Web Beacon is deployed, information collected through it may be associated with an identifier or information linked to a particular recipient, browser, or device. Social Media. The Website may contain links to, or embedded features from, social-media and other third-party platforms. As defined above, Personally-Identifying Information is information that can be directly associated with a specific person. Company may collect a range of Personally-Identifying Information from and about Users. Much of the Personally-Identifying Information collected by Company about Users is information provided by Users themselves when (1) explicitly asked by us to provide such information, or (2) communicating with us. Such information may include each User’s name, address, email address and telephone number. We also may request information about your interests and activities, your gender, age, date of birth, hometown and other demographic or relevant information as determined by the Company from time to time. Users are under no obligation to provide Company with Personally-Identifying Information of any kind, with the caveat that a User’s refusal to do so may prevent the User from using or accessing the Website. Locals Free Program.
If you register for Locals Free, we may collect your name, email address, ZIP code, mobile telephone number if you choose to provide it, eligibility and verification information, and ticket or visit information. We use this information to determine and verify Miami-Dade County residency, administer registration and admission, communicate about the program, prevent fraud or misuse, analyze participation, and, where permitted by law and consistent with this Privacy Policy and your opt-out choices, conduct local-programming outreach and create or use audience segments for marketing or advertising. We may ask you to present proof of residency, but, unless we tell you otherwise at the point of collection, we do not retain a copy used solely for visual verification. By providing an email address and/or telephone number and submitting a registration through a process that presents the applicable marketing disclosure, you consent to receive marketing emails at the email address provided and/or live, nonautomated marketing calls at the telephone number provided, as applicable, as described in this Privacy Policy and the Locals Free Registration Privacy Notice, subject to your right to opt out. As described above, if you provide an email address and/or telephone number at a point of collection that presents the applicable marketing disclosure, we may use the email address provided to send marketing emails and/or the telephone number provided to place live, nonautomated marketing calls, as applicable, concerning services, programming, events, exhibitions, offers, and related news. Mobile Communications.
If you separately provide prior express written consent to receive marketing text messages or marketing calls using an automated system, artificial or prerecorded voice, or prerecorded voicemail, we may send recurring marketing communications concerning local programming, events, exhibitions, offers, and related news using the methods identified in that consent. Consent is not a condition of purchasing any property, goods, or services, admission, or participation in Locals Free. Message frequency varies. Message and data rates may apply. No mobile information will be sold or shared with third parties for promotional or marketing purposes. For purposes of this restriction, mobile information includes mobile telephone numbers, text-message opt-in data, and consent records.
We may disclose mobile information to service providers solely to transmit messages on our behalf or administer the messaging program, subject to contractual restrictions, and as otherwise required by law. Those providers may not use mobile information for their own marketing.
Company Disclosures.
Company will disclose Personally-Identifying Information under the following circumstances:
By Law or to Protect Rights. When we believe disclosure is appropriate, we may disclose Personally-Identifying Information in connection with efforts to investigate, prevent or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of Company, our Users, our employees or others; to comply with applicable law or cooperate with law enforcement; to enforce our agreements or policies, in response to a subpoena or similar investigative demand, a court order or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. As described above, Company may email Users at an email address provided and/or place live, nonautomated calls at a telephone number provided, as applicable, concerning products, services, programming, events, exhibitions, offers, and related news when the applicable collection point presented the marketing disclosure, except where applicable law requires a different consent process. A User may opt out of marketing emails by following the unsubscribe link in an email and may opt out of marketing calls by asking us during any call or contacting us using the information below. Marketing text messages and marketing calls using an automated system, artificial or prerecorded voice, or prerecorded voicemail will be sent only after the User separately provides prior express written consent through a designated sign-up process.
Third-Party Service Providers. We may share your Personally-Identifying Information, which may include your name and contact information (including email address), with authorized third-party service providers that perform services on our behalf. These services may include customer service, communications, marketing assistance, business and sales analysis, Website functionality, security, analytics, ticketing, payment processing, accessibility, and other features described in this Privacy Policy. Such service providers may access Personally-Identifying Information only as reasonably necessary to perform services for us and are subject to applicable contractual and legal restrictions. This paragraph does not limit any responsibility Wynwood Walls has under applicable law for providers that process personal information on our behalf. Independent third-party services with which you interact directly may have their own privacy practices, and, to the fullest extent permitted by law, Wynwood Walls is not responsible for their independent acts or omissions.
Fever Ticketing Platform.
Fever Labs Inc. and its affiliates (“Fever”) operate the third-party platform used for certain ticket searches, reservations, purchases, payments, ticket delivery, admission support, refunds, and related services. When you interact directly with Fever, Fever collects and processes personal information under its own Terms of Use and Privacy Policy. Wynwood Walls and Fever each act as an independent controller of the personal information that each processes and are responsible for their respective processing activities.
To the extent collected and made available to us, Fever may provide us with purchaser and transaction information, including name, email address, ticket type, transaction date and amount, session information, redemption status, source channel, and consent preferences. We may use this information to administer tickets and admission, provide customer support and refunds, prevent fraud, analyze and improve the visitor experience, manage customer relationships, and send marketing communications where permitted by law and consistent with the purchaser’s choices. This Privacy Policy governs Wynwood Walls’ processing of information it receives. Fever’s Privacy Policy governs Fever’s independent processing.

Business Transfers; Bankruptcy. Company reserves the right to transfer all Personally-Identifying Information in its possession to a successor organization in the event of a merger, acquisition, bankruptcy or other sale of all or a portion of Company’s assets. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred Personally-Identifying Information will be subject to this Privacy Policy, or to a new privacy policy if you are given notice of that new privacy policy and are given an opportunity to affirmatively opt-out of it. Personally-Identifying Information submitted or collected after a transfer, however, may be subject to a new privacy policy adopted by the successor organization.
Changing Personally-Identifying Information. You may at any time review or change your Personally-Identifying Information by contacting us using the contact information below. Upon your request, we will deactivate or delete your contact information from our active databases. Such information will be deactivated or deleted as soon as practicable based on your activity and in accordance with our deactivation policy and applicable law. We may retain in our files some Personally-Identifying Information to prevent fraud, to troubleshoot problems, to assist with any investigations, to enforce our Privacy Policy, and to comply with legal requirements as is permitted by law. Therefore, you should not expect that all your Personally-Identifying Information will be completely removed from our databases in response to your requests. Data Retention.
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to complete transactions, administer tickets, admission and Locals Free, maintain business and consent records, provide customer support, resolve disputes, prevent fraud, enforce our agreements, and comply with legal, accounting, tax, and regulatory obligations. In determining retention periods, we consider the nature and sensitivity of the information, the purposes for which it was collected, the risk of harm from unauthorized use or disclosure, applicable limitation periods, and legal requirements. We then delete, deidentify, or securely dispose of the information, subject to lawful archival and backup practices.
General Use.
The Company uses the Personally-Identifying Information in the file we maintain about you, and other information we obtain from your current and past activities on the Website (1) to communicate with you about requested services and, consistent with this Privacy Policy, any applicable consent, and your opt-out choices, about products or services that may be of interest to you from us, our affiliate companies, or other third parties; (2) to develop and display content and advertising tailored to your interests on the Website and other sites; (3) to resolve disputes and troubleshoot problems; (4) to measure consumer interest in our Website; (5) to inform you of updates; (6) to customize your experience; (7) to detect and protect us against error, fraud and other criminal activity; (8) to enforce our Terms and Conditions; and (9) to do as otherwise described to you at the time of collection. Security.
We take the security of your Personally-Identifying Information seriously and use reasonable electronic, personnel and physical measures to protect it from loss, theft, alteration, or misuse. However, please be advised that even the best security measures cannot fully eliminate all risks. We cannot guarantee that only authorized persons will view your information. We are not responsible for third-party circumvention of any privacy settings or security measures.
Privacy Policy Changes.
Company may, in its sole discretion, change this Privacy Policy from time to time. Any and all changes to Company’s Privacy Policy will be reflected on this page and the date new versions are posted will be stated at the end of this Privacy Policy. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you. Users should regularly check this page for any changes to this Privacy Policy. Company will always post new versions of the Privacy Policy on the Website. However, Company may, as determined in its discretion, decide to notify Users of changes made to this Privacy Policy via email or otherwise. Accordingly, it is important that Users always maintain and update their contact information when changes go into effect.
CHILDREN.
The Children’s Online Privacy Protection Act (“COPPA”) protects the online privacy of children under thirteen (13) years of age. We do not knowingly collect or maintain Personally-Identifying Information from anyone under the age of thirteen (13), unless or except as permitted by law. Any person who provides Personally-Identifying Information through the Website represents to us that he or she is at least thirteen (13) years of age or older. If we learn that Personally-Identifying Information has been collected from a User under thirteen (13) years of age on or through the Website, then we will take the appropriate steps to cause this information to be deleted. If you are the parent or legal guardian of a child under thirteen (13) who has become a User or has otherwise transferred Personally-Identifying Information to us, please contact Company using our contact information below to have that child’s information deleted. The Website and online registration processes are not directed to children under thirteen (13). A parent or legal guardian may provide information necessary to obtain admission or register a minor and must complete and control that transaction. We do not knowingly sell or share the personal information of consumers under sixteen (16) years of age without any affirmative authorization required by applicable law.
NOTICE TO NEVADA RESIDENTS.
Nevada law allows consumers to direct certain businesses not to sell their personally identifiable information collected on a business’s platform or other online service to third parties to license or sell that information to additional third parties. We may request information reasonably necessary to verify the authenticity and scope of your request.
ADDITIONAL RIGHTS AND CHOICES FOR CALIFORNIA RESIDENTS.
If you are a California resident, the following additional rights may be available to you.
Shine the Light.
Users who are California residents may request (i) a list of categories of personal information disclosed to third parties during the immediately preceding calendar year for those third parties’ own direct-marketing purposes; and (ii) the names and addresses of the third parties to which we disclosed that information for those third parties’ own direct-marketing purposes. To exercise a request, please send us an email or a letter to the addresses in the section entitled “Contact Us” below and specify you are making a “California Shine the Light” request. We may require additional information from you to verify your identity and are only required to respond to requests once during any calendar year.

Categories of Sources.
We collect personal information from you; your browser or device; Fever and other ticketing, payment, customer-support, and online travel agency providers; our affiliates; and advertising, analytics, social-media, and other service providers.
Business or Commercial Purposes.
We collect, use, and disclose personal information to operate, secure, and improve the Website; administer tickets, payments, refunds, admission, and Locals Free; provide customer support; communicate with Users; analyze participation and Website use; market and advertise; prevent fraud and misuse; enforce our agreements; and comply with law.
Disclosures for Business Purposes.
During the preceding twelve (12) months, we have disclosed identifiers, customer-record information, commercial information, internet or other electronic-network activity, approximate geolocation, sensory information where collected, and inferences to service providers and contractors that provide hosting, information technology, security, analytics, communications, customer relationship management, ticketing, payment processing, fraud prevention, customer support, advertising, and professional services.
Sale or Sharing.
We do not sell personal information for money. During the preceding twelve (12) months, we may have “shared,” as that term is defined by the CCPA, online identifiers and internet or other electronic-network activity with advertising, analytics, or social-media providers for cross-context behavioral advertising. You may opt out through Your Privacy Choices or a legally recognized opt-out preference signal. We do not knowingly sell or share personal information of consumers under sixteen (16) years of age.
Sensitive Personal Information. We do not use or disclose sensitive personal information for purposes that require a right to limit under the CCPA. See “Data Retention” above for the criteria used to determine retention periods.
Right to Know and Access.

Company does not sell personal information for money. Certain disclosures of online identifiers and internet or other electronic-network activity to advertising, analytics, or social-media providers may nevertheless be considered a “sale” or “sharing” under the CCPA. How to Exercise Your CCPA Rights.
To exercise a right to know, access, delete, or correct, please email info@thewynwoodwalls.com, call (305) 576-3334, or use the request mechanism available through Your Privacy Choices. To opt out of sale or sharing, use Your Privacy Choices or a legally recognized opt-out preference signal. In your request, specify the right you seek to exercise and the scope of the request. We will confirm receipt within ten (10) business days and respond within the period required by applicable law. We may request information reasonably necessary to verify your identity. An authorized agent may submit a request on your behalf as permitted by law, subject to verification of the agent’s authority. If we deny a request and applicable law provides a right to appeal, you may appeal by replying to the denial or emailing us with “Privacy Appeal” in the subject line.
If you choose to exercise any of these rights, you will not receive different prices or quality of services unless permitted by applicable law, including where those differences are reasonably related to your information.
Please note that if you opt out of receiving one form of communication, it does not mean you’ve opted out of other forms as well. For example, if you opt out of receiving marketing emails, you may still receive marketing text messages if you’ve opted in to receiving them.

DO-NOT-TRACK POLICY
Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting. Because there is not yet a uniform standard for interpreting DNT signals, the Website currently does not respond to DNT signals. DNT is different from a legally recognized opt-out preference signal. Where required by applicable law, we process Global Privacy Control and other legally recognized opt-out preference signals as requests to opt out of sale, sharing, or targeted advertising for the browser or device that sends the signal.
